PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue writ of mandamus, directing the respondents to permit the petitioner to pay the balance fees of Rs.37,000/- as per the order of allotment dated 30.10.2022 issued by the 2nd respondent board allotting the petitioner the seat in Chemical Engineering Bachelor of Technology in the 4th respondent College and accordingly, permit the petitioner to join the course in the 4th respondent College and pass such further orders.

ORDER
The prayer in the writ petition is to permit the petitioner to pay the balance fees of Rs.37,000/- as per the order of allotment dated 30.10.2022 issued by the 2nd respondent board whereby the petitioner was allotted a seat in Chemical Engineering Bachelor of Technology in the 4th respondent college. Upon hearing the learned Counsel for the petitioner, the learned Senior Panel Counsel appearing on behalf of the respondents and perusing the material records of the case, it can be seen that the petitioner duly applied for admission and was allotted a seat and by mistake, the petitioner did not pay the fee in time and therefore, the petitioner approached this Court and by way of an interim order, the petitioner was permitted by this Court to pay the balance fees beyond the cut off date and the petitioner is also now undergoing the 2/4
course. Therefore, though it is the mistake of the petitioner, the 4th respondent institute shall condone the delay in payment of fees and it shall be deemed that the petitioner has paid the fees within the time limit and shall undergo the course and shall complete the same without any hiccup, whatsoever. 3.
With the above observations, the Writ Petition stands disposed of. It is made clear that this order is passed in the special facts and circumstances of the present case alone. No costs. Consequently, the connected miscellaneous petition is closed.
