O R D E R
The petitioner, who was arrested and remanded to judicial custody on 08.07.2025, for the offence punishable under Sections 417 and 420 of IPC in Crime No.23 of 2025, registered on the file of the respondent, seeks bail.
2. The case of the prosecution is that, the defacto complainant lodged a complaint before the respondent police stating that, the petitioner herein as an agent of a Finance company by name M/s. Sikaram Asset Promoters India Ltd at Salem has collected deposits from the defacto complainant and 27 others, a sum of Rs.600/- every month and after collecting for 48 months, promising high returns had failed to return the money, thereby cheated money around Rs.6,73,000/-. Hence, the present complaint.
3. The learned counsel appearing for the petitioner seeks bail by stating that the petitioner is only an agent and the person in-charge of the company is A1. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. 2/6

The learned Government Advocate (Crl.Side) appearing for the respondent police opposed the bail petitioner by stating that the petitioner herein as an agent had received the money from the depositors and he along with other accused had failed to return the money collected after promising high returns.
5. Heard both sides and perused the materials available on record.

Considering the nature of the complaint and the quantum of amount cheated, this Court is of the view that the petitioner, who is in prison since 08.07.2025 be released on bail, so that enable him to return the money that he had collected from the depositors. For the said purpose, this Court is inclined to grant bail to the petitioner with subject to certain conditions.
7. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.1, Perambalur and on further conditions that: 3/6
[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;
[b] the petitioner shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) to the credit of Crime No.23 of 2025 before the learned Magistrate concerned at the time of execution of sureties; [c] the petitioner shall report before the respondent police daily at 10:30 a.m., until further orders;
[d] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 22.08.2025 stn Note :
