[Order of the Court was made by S.S.SUNDAR, J.] This Criminal Miscellaneous Petition is filed to suspend the sentence imposed upon the petitioner/accused vide judgment dated 31.07.2023 in S.C.No.58 of 2022, passed by the learned learned Additional District Judge (FTC), Arni, Tiruvannamalai District.

2. Heard the learned counsel on either side.

3. This Court is unable to convince ourselves, as the judgment of the trial court is convincing and conviction is based on substantial evidence. Though, it is stated that some of the eyewitnesses have turned hostile, it is recorded that the eyewitnesses have partly turned hostile. From the evidence, substantial portion of the witnesses, has been accepted and this Court is unable to find any reason to find fault with the conviction. Hence, this Criminal Miscellaneous Petition is dismissed.

5. Registry is directed to post the main appeal in the usual course.
