PRAYER: Writ Petition filed under Article 226 of Constitution of India, praying for issuance of Writ of Mandamus directing the third respondent to consider the petitioner's appeal representation dated 03.04.2025. For Petitioner :
Mr.Vasanthan.B For Respondents 1 to 4 : Mr.P.Ganesan, Government Advocate
O R D E R
The petitioner has filed this petition to the third respondent to consider the petitioner's appeal representation dated 03.04.2025.
2. Mr.P.Ganesan, learned Government Advocate takes notice on behalf of respondents 1 to 4. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.
3. The case of the petitioner is that the petitioner's mother purchased an agricultural land measuring an extent of 8.05 acres, situated in S.No.396, Block-3, Semmancheri Village, Sholinganallur Taluk, by way of a registered Sale Deed dated 26.02.1969, registered as Doc.No.1316 of 1969 on the file of the Sub-Registrar Office, Saidapet. After the demise of petitioner's mother on 21.06.2023, the petitioner found that the said land had been reflected as Page No.2 of 6
"Tharisu Nilam" (barren land) in the name of Government. Therefore, the petitioner sent a representation dated 19.06.2024, seeking to correct the mistake and transfer the patta on her name, by enclosing all supporting documents. Since, no action was taken, the petitioner filed W.P.No.37923 of 2024, before this Court and the same was disposed on 18.12.2024, by directing the authorities to consider the petitioner's representation. However, without properly considering the documents, the fourth respondent passed an order dated 28.03.2025, stating that the land has been given to the Youth Welfare and Sports Development Department. Challenging the said order, the petitioner preferred an appeal. Since, no order was passed, the petitioner sent an appeal representation dated 03.04.2025. However, till date, no order was passed. Hence, the petitioner has come forward with the present writ petition.
4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that it would suffice if this Court issues direction to the third respondent to dispose the appeal representation dated 03.04.2025 filed by the petitioner.
5. Learned Government Advocate appearing for the respondents 1 to 4 Page No.3 of 6
submitted that the petitioner's appeal representation would be considered and orders passed, within a time frame that may be fixed by this Court.
6. Heard the learned counsels on either side and perused the materials available on record.
7. Considering the limited relief sought for by the learned counsel for the petitioner, this Court directs the third respondent to dispose the petitioner's appeal representation dated 03.04.2025 on merits and in accordance with law and pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order.
This writ petition is disposed of with the aforesaid direction. No costs. 02.09.2025 vm Index :
