This petition has been filed to modify the condition imposed upon the petitioner, by this Court in Crl.O.P.No.19079 of 2023 dated 04.09.2023.

2. Learned counsel for the petitioner submitted that there are five accused in this case and the fact remains that only an amount of Rs.1,25,000/- has been transferred to the account of this petitioner through Gpay on 26.03.2022 and other than that the petitioner has not received any amount. Further the case of the de facto complainant is that on the instigation of the petitioner, he had deposited an amount of Rs.1,20,000/- to the account of one Vignesh on 11.06.2022. He further reiterated that the petitioner has received only a sum of Rs.1,25,000/-, whereas, this Court, while granting anticipatory bail to the petitioner, directed him to deposit a sum of Rs.2,45,000/- to the credit of Crime No.185 of 2023. Thereby, the petitioner seeks for modification of the condition.

3. Learned Government Advocate (Crl.Side) submitted that as per the investigation, a sum of Rs.1,25,000/- has been transferred to the account of the petitioner through Gpay on 26.03.2022.

Considering the submission made by the learned counsel appearing for the petitioner, the amount to be deposited to the credit of Crime No.185 of 2023 is modified as Rs.1,25,000/- (Rupees One Lakh and Twenty Five Thousand Only). Further, two weeks time is granted to the petitioner to comply with the conditions as directed by this Court, from the date of receipt of copy of this order.

5. It is made clear that the rest of the order shall remains unaltered.

6. With the above direction, this Criminal Miscellaneous Petition stands ordered.
