ORDER

The writ petition is filed seeking direction to the respondents to take into account the service rendered by the petitioner from initial appointment till regularization (i.e. 01.09.1982 to 31.03.1990) for the purpose of retirement benefits including pension.

2. Heard Mr.R.Saravanakumar, learned counsel for the petitioner and Mrs.S.Mythreye Chandru, learned Special Government Pleader(Education) for the Respondents.

3.The case of the petitioner is that the petitioner was initially appointed as a Double Part Time Vocational Instructor from 01.09.1982 in Government Higher Secondary School, Veppanapalli(PO), Krishnagiri(TK), Krishnagiri District and thereafter as Full-Time Vocational Instructor with effect from 01.04.1990 and had retired from service on 28.02.2015. For pension purposes, only his regular service was taken into account and the 50% of the Part-Time service has not been considered.

4. The petitioner had relied on several precedents, where similarly placed persons, including in W.P.No.39177 of 2002 and W.P.No.4556 of 2/4

2007, were granted revision of pensionary benefits by counting 50% of the Part-Time service along with the regular service. The petitioner had submitted a representation dated 22.12.2023, seeking similar relief, which has not been considered by the respondents. Hence, the petitioner is constrained to move the present writ petition. 5.Considering the facts and circumstances of the case and in the light of the earlier orders passed by this Court, without going into the merits of the case, the respondents are directed to consider the case of the petitioner and pass orders on the representation submitted by the petitioner dated 22.12.2023 on its own merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. In fine, the writ petition stands disposed of. However, there shall be no order as to costs.
