ORDER
The original petition has been filed by the petitioner under Sections 232 and 276 of the Indian Succession Act and Order XXV Rule 5 of the Original Side Rules to grant Letters of Administration with the Will annexed in the petition as son of the deceased and also the legatee under the Will of the deceased, having effect limited to the State of Tamil Nadu.

According to the petitioner, the testatrix, namely Mrs.K.Karpagam alias V.Shanthi had executed a Will dated 08.11.2018 in favour of the petitioner and one Mrs.Balaramya, who is the wife of the first respondent and mother of the second respondent. Thereafter, the said Mrs.Balaramya died on 20.09.2019, leaving behind the respondents as her legal heirs. The respondents/son-in-law and grand-daughter of the testatrix, namely Page No.2 of 7
Mrs.K.Karpagam alias V.Shanthi, have no objection and filed consent affidavits to grant Letters of Administration in favour of the petitioner.
3. The petitioner is one of the beneficiaries along with his sister Mrs.Balaramya. No executor was appointed in the said Will. The said testatrix, namely Mrs.K.Karpagam alias V.Shanthi died on 26.09.2021. Therefore, after the demise of the said Mrs.K.Karpagam @ V.Shanthi, the Will came into effect. Hence, the petitioner has filed this petition.
4. After the filing of this petition, this Court directed the petitioner to effect paper publication, and the same was also effected and thereafter no objection was received from any party. Thereafter, the case was posted for recording evidence, and the evidence also was recorded. On the side of the petitioner, P.W.1 and P.W.2 were examined and Exs.P1 to P9 were marked. The Original Will dated 08.11.2018 has been marked as Ex.P1.
5. P.W.1 is the petitioner and he is the son of the testatrix. P.W.2 is the attesting witness of the Will dated 08.11.2018 and he deposed about the Page No.3 of 7
execution and attestation of the Will. Therefore, the execution and attestation of the Will dated 08.11.2018 are duly proved in accordance with law. There is no any rival claim against the Will and the respondents/son-inlaw and grand-daughter of the testatrix, namely Mrs.K.Karpagam alias V.Shanthi, also filed consent affidavits to grant Letters of Administration in favour of the petitioner. As per the Will, the petitioner is one of the beneficiaries. Hence, the petitioner is entitled to the relief of the grant of Letters of Administration in his favour.
6. Therefore, this Original Petition is allowed and Letters of Administration in respect of the Will dated 08.11.2018 executed by Mrs.K.Karpagam alias V.Shanthi (deceased), W/o. Late Shri. V.Venkatraman in favour of the petitioner, is granted.
7. Issue Letters of Administration in favour of the petitioner. The petitioner is directed to duly administer the properties and credits of the deceased more fully described in the schedule. The petitioner is also directed to execute a security bond for a sum of Rs.25,000/- (Rupees Page No.4 of 7
Twenty Five Thousand only) in favour of the Assistant Registrar (O.S.No.II), High Court of Madras. The petitioner is further directed to render true and correct accounts once a year. 16.09.2025 dk Index : Yes/No Speaking Order : Yes/No List of Petitioner side Witnesses:
