This writ petition is filed seeking a writ of mandamus directing the respondents 1 to 3 herein to dispose of the petitioner's representation dated 13.09.2014 in accordance with law and to take action for removal of the illegal encroachment made in Thenmelpakkam Village at the joining of Mariamman Koil Street and Anjur Pudhupet within a time frame. 3.
In response to the notice dated 23.02.2016 ordered by this Court, the third respondent/ Tahsildar, Chengalpattu, Kancheepuram District, has filed an affidavit admitting that a small portion of the land has been encroached by the 4th respondent and garden has been created. The area in question falls within the jurisdiction of the Block Development Officer, Kattankulathur, Chengalpattu, Kancheepuram District. Thus, the Block Development Officer, Kattankolathur, Chengalpattu, Kancheepuram District will be directed forthwith to retrieve the area in question, within a period of two weeks, after affording opportunity of hearing to the alleged encroachers. 4.
In view of the above statement made in the counter affidavit filed by the third respondent, it is ordered accordingly.
With the above observation, this writ petition is disposed of. No costs.
