The petitioner has filed this Writ Petition to quash the F.I.R. No.54 of 2004, dated: 26.04.2004.

2. On perusal of paragraph No.5 and 6 of the Counter Affidavit, this Court finds that the respondents 2 & 3 obtained the opinion from the Special Public Prosecutor III, Madurai on 18.08.2004. Based on the above said opinion given by the Special Public Prosecutor III, Madurai, the file was closed as "Mistake of Fact".
