The petitioner /A3, who was arrested and remanded to judicial custody on 04.08.2023 registered by the respondent Police for the offences under Sections 354(D), 366, 342, 328, 354(C), 506(i) of IPC, 5(1), 6, 17 of POCSO Act, 2012 r/w Sections 66E & 67A of IT Act and Section 4 of TNPHW Act, in Crime No.83 of 2023, seeks bail. 2.The victim girl is aged 17 years. It is stated that A1 had taken her to a deserted house and committed sexual offence on her. 3.The allegation against A2 and A3 is that they had taken photographs and they had circulated the photographs to the sister of the victim girl.
4.The learned counsel for the petitioner stated that the petitioner is an innocent person.
5.It is stated by the respondent that A1 is still absconding and there is every possibility of the witnesses being influenced and the evidence being tampered.
6.In view of that particular fact, this Court is not inclined to grant bail to the petitioner.
