Prayer : Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents to regularise the petitioner's service from the date of order passed in W.P. No.48555/2006 (O.A. No.1428/2001) on 21.06.2010 with all service benefits by considering my representation dated 31.01.2022. For petitioner : Mr.R.Govindasamy For respondents : Mr.T.M. ORDER
By consent of both the parties, this writ petition has been taken up for final disposal at the admission stage itself.
2. Mr.T.M. Rajangam, learned Government Advocate accepts notice for the respondents.
3. This writ petition has been filed for a Mandamus seeking for a direction to the respondents to regularise the petitioner's service from the date of the order passed in W.P. No.48555 of 2006, dated 21.06.2010 based on the petitioner's representation, dated 31.01.2022.
4. The petitioner claims that she was appointed under the compassionate quota pursuant to order dated 21.06.2010 passed in W.P. 2/6
No.48555 of 2006. However, according to her, despite the said order, she was issued appointment orders only in the year 2015. Earlier, her husband was employed in public service, but he died while he was in service and only under those circumstances, she was given employment under the compassionate quota pursuant to orders passed by this Court. The petitioner seeks for regularisation of her service from the date of the order passed in W.P. No.48555 of 2006. i.e. 21.06.2010. She has given a representation on 31.01.2022 for the said purpose.
5. Heard Mr.R.Govindasamy, learned counsel for the petitioner and Mr.T.M. Rajangam, learned Government Advocate for the respondents.
6. No prejudice would be caused to the respondents, if the petitioner's representation as stated supra is considered on merits and in accordance with law within a time frame to be fixed by this Court.
7. For the foregoing reasons, this Courts directs the 2nd respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 31.01.2022 seeking for regularisation of her service from the date of the order passed in W.P. No.48555 of 2006 3/6
on 21.06.2010, within a period of 12 weeks from the date of receipt of a copy of this order.
8. With the aforesaid directions, this writ petition is disposed of. No costs.
