Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents 2 to 4 namely the Superintending Engineer, Udumalpet, The Divisional Engineer, Angalakurichi, Pollachi, the Executive Engineer, Angalakurichi, Polachi to consider the representation of the petitioner dated 03.06.2019 and 19.06.2019 and take necessary action to give electricity connection to the bore well of the petitioner in S.No.178/A2B, Pongaliyur from the electricity pole in the PAP supply line which is 15 meters from the said bore well within a time to be stipulated by this Court.

The petitioner herein is an Agriculturist. He had applied for electricity service connection to draw water from the borewell in S.F.No.178/A2B, Pongaliyur Village. 2.The grievance of the petitioner is that in spite of remitting the requisite fee, the respondents have not so far given service connection. For providing the service line, the authority has decided to give connection from the transformer far away from his land instead of the transformer within 15 meters away from her land.
3.The learned counsel appearing for the petitioner submits that the petitioner under the Tatkal scheme has paid the requisite fee and his petition has to be considered as per seniority. Four more applicants were ahead of the petitioner and after providing electricity service connection to them the petitioner will be given electrical service. 4.Further the learned counsel for the respondents would submit that the transformer referred by the petitioner is meant for urban feeders to cater to the needs of industrialist where the supply will be in 3 phase 24/7. Whereas, agriculturists are provided free power supply from the rural feeder, where power supply will be in shifts for particular duration.
5.Considering the averments of the respective counsels and perusing the affidavit, this Court holds that the plea of the petitioner to get line from urban feeder is not sustainable. At the same time, his request for electric service connection is legal and the respondents are bound to satisfy his legitimate expectation as early as possible. Therefore, the respondents 2 to 4 are hereby directed to expedite the process of providing service connection to the petitioner's borewell as early as possible, in any event not later than four months.
Writ Petition is disposed of with the above directions. No costs.
