IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 10.11.2022 CORAM :
THE HONOURABLE Ms. JUSTICE R.N.MANJULA E.Dilli ... Petitioner Vs 1.The Superintendent of Police District Police Office Ranipet-632 401.
2.The Inspector of Police Rural Police Station Arakkonam Ranipet-631 003.
... Respondents PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C., praying to direct the Judicial Magistrate, Arakkonam for speedy disposal of the petition in Crl.M.P No.375/2022 filed by the petitioner. For Petitioner : Ms.M.Kruthika For Mr.R.Vivekananthan For Respondents : Mr.S.Santhosh Government Advocate (Crl.side) 1/5
O R D E R
The Criminal Original Petition has been filed, seeking a direction to the Judicial Magistrate, Arakkonam for speedy disposal of the petition in Crl.M.P No.375/2022 filed by the petitioner.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents.
3. It appears from the records that in the said Crl.M.P No.375 of 2022, copy application was filed by the petitioner seeking the copy of the report submitted to the Court by the Superintendent of Police, Ranipet in pursuance of the order of the Court dated 27.04.2022. The said copy application has been returned by stating that the original records are not available on file.
4. It is understandable that the petitioner has filed a petition under Section 156(3) Cr.P.C and the learned Magistrate has sought a report from the 1st respondent viz., The Superintendent of Police, Ranipet in this regard. For the purpose of the same, a petition has also been sent to 2/5
Superintendent of Police, Ranipet. As directed the Superintendent of Police, Ranipet has not filed a report to the Court so far. Unless the report is filed, it is not possible for the learned Magistrate to furnish the order copy as requested by the petitioner in Crl.M.P No.375 of 2022. Instead of seeking a direction to the Superintendent of Police, Ranipet, to comply the order of the Magistrate and file a report, the petitioner has filed this petition seeking a direction to the learned Magistrate to dispose of the Crl.M.P No.375 of 2022. Without having the case records and without the receipt of the report from the Superintendent of Police, Ranipet, it is not practically possible for the Judicial Magistrate to dispose of the Crl.M.P No.375 of 2022.
5. In view of the above stated reasons, I feel it is appropriate to give direction to the 1st respondent viz., The Superintendent of Police, Ranipet, to submit his report in compliance of the order dated 27.04.2022 passed in Crl.M.P No.375 of 2022, by the learned Judicial Magistrate, Arakkonam.

6. With the above direction, this Criminal Original Petition is disposed of .
