The second respondent herein has filed a petition under Section 190(1)(a) read with Section 156(3) of Cr.P.C in CMP.No.88 of 2017, before the learned Judicial Magistrate, Ranipet, Vellore District, to register FIR by the respondent police and the learned Judicial Magistrate taken the complainant and referred the matter for registration of FIR by the respondent police. As aggrieved against the said order, third parties have preferred this Criminal Revision Case alleging that the original petitioner before the Magistrate Court is the son of the first petitioner herein viz., the first respondent herein. For the fault committed by the first respondent herein, in paying the monthly instalments to the Hypothecated tractors, they have been seized and subsequently, sold to the third petitioner herein.

2.The learned Government Advocate (Crl.Side) appearing for the first respondent would submit that pursuant to the direction issued by the learned Judicial Magistrate, Ranipet, Vellore District, the first respondent - Inspector of police, Ranipet Police Station, has filed a case in crime No. 320 of 2017 and after investigation, they have closed as "the case as mistake of fact" in R.C.No.14 of 2018 on 29.09.2018 and hence, there is nothing survives in this petition.

3.Recording the same, this Criminal Revision Case stands dismissed and consequently, connected Miscellaneous Petition closed.
