Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to pay the compensation of Rs.50,00,000/- (Fifty Lakhs Rupees Only) for the loss of his professional career, reputation and causing mental agony for the petitioner, within the time limit fixed by this Hon'ble Court. O R D E R

This writ petition has been filed seeking issuance of Writ of Mandamus directing the respondents to pay the compensation of Rs.50,00,000/- (Rupees Fifty Lakhs Only) for the loss of the petitioner's professional career, reputation and mental agony. 2.The learned counsel appearing for the petitioner submitted that the petitioner was working as an Executive Engineer Civil NI in Kadambarai Generation Circle, TANGEDCO, Minparai, Coimbatore District from 07.06.2012 and was transferred to the Minparai Civil Section and Upper Aliyar Civil Section. While the petitioner was 2/6

inspection Upper Aliar Dam Civil Section on 13, 14, 15 and 16 of August, 2012, he noticed that the seventh respondent was unauthorisedly absent and hence, the petitioner issued memo on 16.08.2012 to the seventh respondent. The learned counsel further submitted that after receiving the memo, the seventh respondent preferred false complaint before the All Women Police Station, Pollachi on 18.08.2012 and the same was transferred to Valparai Police Station, due to which, the petitioner was suspended from service with effect from 11.09.2012 and was not allowed to retire on attaining the age of superannuation on 31.01.2014. Thereafter, the petitioner was acquitted from the criminal case by the learned Judicial Magistrate, Valparai in C.C.No.65 of 2012 dated 20.03.

2014 and with regard to another false complaint, the petitioner was acquitted by the learned District Judge, Coimbatore in Crl.A.No.49 of 2014 dated 07.11.2014. Thereafter, the petitioner claimed a sum of Rs.50 Lakhs for the loss of his professional career, reputation and mental agony from the official respondents, however, there is no response.

3.Though the writ petition is of the year 2017, the respondents have not yet filed a counter affidavit. Hence, this Court is inclined to dispose of the writ petition based on the materials available on record. 3/6

4.Perusal of records reveal that after filing of complaint by the seventh respondent and after registration of the complaint by the law enforcing agency, departmental proceedings was initiated by the official respondents. Though the petitioner was subsequently acquitted from the criminal proceedings, it will not give any right to the petitioner to claim compensation from the official respondents. If at all the petitioner have any grievance as against the seventh respondent, he can adjudicate the same before the competent Forum, instead the petitioner has filed this writ petition and such approach of the petitioner cannot be entertained. Hence, this Court is not inclined to grant the relief sought for in this writ petition. 5.The writ petition is dismissed. However, liberty is granted to the petitioner to approach the competent civil Court as against the concerned individual in the manner known to law.
