This application is filed for grant of leave to the applicant to institute the suit against the 3rd defendant.

2. Mr.J.Kingsly Soloman, learned counsel represented that he seeks to file counter.

3. I have perused the typed set of papers. This court in earlier proceedings in O.S.A.Nos.198 and 188 of 2024 and batch, dated 12.04.2024 and C.S.No.274 of 2022 and A.No.5961 of 2022 and batch dated 05.09.2023 have already held that this Court has jurisdiction to try the cases in respect of the very same set of parties.

4.In view of the same, leave is granted. This application is allowed. The Registry may proceed to number the suit, if it is otherwise in order. Copies of the papers in C.S.DR.No.126926 of 2024 may be furnished by the evening to the other side so as to agitate the matter for the third respondent.
