ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The entire basis of petitioner's case rests on her claim over the land, which is subject matter of sale and purchase by third respondent/builder, under a housing development scheme.

2. On petitioner's own showing, she has already filed a suit against the third respondent seeking a declaration of her own title in respect of the land in dispute.

3. The petitioner cannot be permitted to file a writ petition only to seek injunction against the third respondent. If the petitioner seeks injunction against the third respondent, her remedy lies in moving such application in the pending suit rather than coming to the writ Court.

Both the petitions are misconceived and accordingly, dismissed, with liberty to pursue the remedy before the Civil Court. There shall be no order as to costs.
