C.M.P.No.21376 of 2022 in S.A.Sr.No.90966 of 2012 P.T.ASHA, J., This petition is filed to condone the delay of 161 days in filing the above appeal in S.A.Sr.No.122613 of 2022.

2. Heard the learned counsel for the petitioner/appellant. Private notice sent to the respondent has been returned with an endorsement "unclaimed". It is also seen that intimation has been given to the addressee on two occasions. Therefore, there is a deemed service on the respondent.

3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 161 days in filing the above appeal in S.A.Sr.No.122613 of 2022 is condoned.

4. The Registry is directed to number the appeal, if it is otherwise in order and list the same for admission.
