Respondents Prayer: Petition filed under Article 226 of the Constitution of India to issue a writ of certiorarified mandamus calling for the records in connection with order Na.Ka.No.54197/NP4/3/2014 dated 24.10.2014 passed by the Director of Rural Health Service, Chennai, the second respondent herein and quash the same, consequently direct the second respondent to regularize the maternity leave with full salary.

O R D E R

The petitioner has come to this Court, challenging the impugned order dated 24.10.2014, passed by the Director of Rural Health Services, Chennai/the second respondent herein, refusing to grant the maternity leave benefits. As against the same, the petitioner has filed an appeal before the Secretary to the Government, Health Department on 25.01.2016.

2.Learned counsel appearing for the petitioner limited his prayer only for a direction to the first respondent to pass orders on the pending appeal.

3.Learned Additional Government Pleader appearing for the respondents sought twelve weeks time to consider the pending appeal.

4.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.

5.In the light of the limited relief sought for in the writ petition, there shall be a direction to the first respondent to consider the pending appeal dated 25.01.2016, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
