Prayer Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the second respondent herein to consider the petitioner's representation dated 10.01.2022 seeking sub division of the petitioner's property situated at Venkatapuram village, Chengalpattu Taluk and District in survey No.249/1 admeasuring to an extent of 2100 square feet and to issue patta in his name for the same. Order Heard Mr.G.Mahesh Kumar learned counsel appearing for the petitioner, Mr.T.K.Saravanan learned Additional Government Pleader for respondents 1 and 2 and Mr.M.Jothikumar, learned counsel for the third respondent.

This Writ Petition is filed seeking for the following prayer:- i) For Mandamus directing the second respondent to consider the petitioner's representation dated 10.01.2022 seeking sub division of the petitioner's property morefully described in the prayer of this Writ Petition and to issue patta in his name.
3. Learned counsel for the petitioner would submit that the petitioner made a representation to the second respondent seeking for the aforesaid relief, but the same has not evoked any response, hence, this Writ Petition.
4. The learned counsel for the third respondent would submit that the properties comprised in S.No.249/1 has been encroached upon by several persons and in this regard, the third respondent also given a representation to the respondents to enquire into the issue but the same is pending. 2/6

The learned Additional Government Pleader for the respondents 1 and 2 submitted that based on the representation given by the third respondent, the first respondent forwarded a communication dated 31.11.2023 to the second respondent, directing him to enquire into the issue and to issue patta, based on which, already enquiry has been conducted but not yet ccomplete; that since the petitioner also made such representation seeking for sub-division of the property, the said representation would be also be considered and enquiry would be conducted in line with the proceeding issued by the first respondent dated 31.11.2023 and would be completed with a time frame as stipulated by this Court, and hence, seeks for issuance of a direction in that regard.
6. I have given due considerations to the submissions made by the learned counsel for the parties concerned and perused the materials placed on record.
7. It is the case of the petitioner that the property at Venkatapuram Village, Chengalpattu Taluk and District in S.No.249/1 admeasuring to an extent of 47.5 ares i.e. 1 Acre 17 cents belongs to one Thulukanam. Out of 3/6
the said 1 acre and 17 cents, the third respondent claims to have purchased 1 acre from the said Thulukanam, as, EC reflects the same. So far as the petitioner is concerned, he has purchased the property measuring 2100 sq.ft from the legal heirs of the said Thulukanam,

As like the third respondent, who after the said purchase sought for sub-division of the property by making a representation to the first respondent, who, in pursuance of the same, forwarded a communication dated 31.11.2023 to the second respondent, directing the second respondent to enquire into the issue and issue patta, so also the petitioner seeks for subdivision and issuance of patta in his name by making a representation dated 10.01.2022 to the second respondent.

Thus, this Court taking into considerations of the submissions made by the learned Additional Government Pleader for respondents 1 and 2 is inclined to dispose of this Writ Petition by directing the second respondent to conduct enquiry based on the petitioner's representation in line with the enquiry, which they had already began based on the first respondent's proceedings dated 31.11.2023, after issuing notice to the petitioner and the 4/6
third respondent and complete the process by passing final orders with regard to sub-division of the property and issue patta to the petitioner and third respondent, if they are legally entitled to within a period of three weeks from the date of receipt of a copy of this order.
