ORDER

This Criminal Original Petition has been filed to transfer the case in Crime No.25 of 2015 from the first respondent to CB CID for fair investigation and to file a final report according to law within the stipulated time.

Heard Mr.M.Rajendran, learned counsel for the petitioner, Mr.S.Vinoth Kumar, for PP for R.R.1 and 2, Mr.M. Sairam, learned counsel for R.R.5 and 10 and Mr.R.Sreerangan, learned counsel for R.R.7 to 9.

3. Mr.S.Vinoth Kumar for PP for R.R.1 and 2 submitted that investigation has been completed and further action was dropped.

4. It is to be noted that the very allegation itself would indicate that investigation has already been completed by the respondent Police and charge sheet has also been filed. Instead of filing protest petition before the learned Magistrate, the petitioner has come before this Court praying to transfer the investigation from the file of first respondent to CB CID, which is not permissible.

5. Accordingly, this Criminal Original Petition is dismissed. Liberty is granted to the petitioner to work out his remedy in the manner known to law.
