Aggrieved by the acquittal of the respondent for the offences punishable under Section 138 of Negotiable Instruments Act, the petitioner/complainant has filed the present petition seeking leave to file an appeal.

2. The learned counsel for the petitioner would submit that the lower appellate Court has reversed the well considered judgment of the trial Court, which had convicted the respondent for the offence under Section 138 of the Negotiable Instruments Act; that the reason for acquittal viz., that the stolen cheques were misused by the petitioner has not been established; that the respondent had not filed any criminal complaint; that the finding that the petitioner had no source for lending the cheque amount, is not based on evidence and therefore prayed for grant of leave to file an appeal.

3. The points raised by the petitioner require consideration by this Court and hence, leave is granted to file an appeal.

4. Registry is directed to number the appeal and post for admission, if it is otherwise in order.
