Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the second respondent to dispose of the appeal dated 15.05.2024 preferred by the petitioner against the impugned order passed by the third respondent in Moo.Mu.No.A1/1643/2023 dated 09.05.2024 canceled the petitioner's patta in Survey No.33/2 to an extent of 0.2392 square meter classified as Natham, situates in Anaivari Revenue Village, Bhuvanagiri Taluk, Chidambaram Revenue Division, Cuddalore District, within the time frame that may be fixed by this Court. O R D E R

The petitioner herein seeks a direction to the second respondent to dispose of the appeal dated 15.05.2024 filed by him challenging the order passed by the third respondent in Moo.Mu.No.A1/1643/2023 dated 09.05.2024 cancelling the patta issued in favour of the petitioner in respect of 2/6

the property situated in S.No.33/2 with an extent of 0.2392 square meter, at Anaivari Revenue Village, Bhuvanagiri Taluk, Chidambaram Revenue Division, Cuddalore District, within a time frame fixed by this Court.

2. It is the case of the petitioner that the subject property belonged to him and recognizing his possession patta was issued in favour of the petitioner. On the basis of the representation given by the sixth respondent, the third respondent herein cancelled the patta issued in favour of the petitioner on 09.05.2024. Challenging the same, the petitioner filed a revision before the second respondent on 15.05.2024 and the same is pending on the file of the second respondent without any progress. Hence, the petitioner is before this Court.

3. Mr.P.Sathish, learned Additional Government Pleader, who takes notice for the respondents 1 to 5 would submit that the revision is pending on the file of the second respondent and the same will be considered on its own merits, within a time frame fixed by this Court. 3/6

In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the second respondent to dispose of the appeal filed by the petitioner dated 15.05.2024 and pass final order, on its own merits, within a period of 8 weeks from the date of receipt of copy of this order, after issuing necessary notice to the petitioner and sixth respondent.

5. With the above direction, this Writ Petition is disposed of. No costs.
