O R D E R
Earlier, this Court by an order dated 11.11.2014 in M.P. No. 1 of 2014 in S.A.No.1041 of 2014 was pleased to pass an order of interim injunction in so far as the area in occupation of the appellant except the school area, where the school exist. Alleging that the respondents herein even after knowingfully well the order of injunction passed by this Court, have purposely stated construction for additional building for the school, the present Contempt Petition has been filed.
2. Mr. A.Edwin Prabakar, learned Addl. Government Pleader appearing for respondents would submit that so far, the finality in the above Second Appeal is not reached. Hence, this Contempt Petition may be closed. 2/4
3. Considering the facts and circumstances and on considering submissions of both sides and also the fact that so far, the finality was not reached in the aforesaid Second Appeal, the Contempt Petition filed by the petitioner is pre-mature. Hence, the same is liable to be closed. Accordingly, this Contempt Petition is closed.
