This miscellaneous petition has been filed seeking to modify the Order passed by this Court dated 21.09.2023 in the above writ petition.

2. The petitioner, originally, challenged the order reverting her from designated officer to the parent Department on the ground of certain allegations. This Court, thoroughly considered and captured the factual aspect in paragraph 10 of the Order passed in the above writ petition. It specifically noted that the petitioner, who had been drawn from the parent Department, a lean and seniority of the Food Safety Officers drawn from the other Department ordered to be preserved and maintained, with resultant benefit to them in the parent Department.

4. Such view of the matter, when the petitioner has been relieved to the parent Department, now, once again the petitioner, as a matter of right, cannot seek appointed as Food Safety Officer.

5. Accordingly, I am not inclined to modify the above order and this miscellaneous petition stands dismissed. No costs. 21.12.2023 dhk https://www.mhc.tn.gov.in/judis
