M.Mohammed Hanifa v. K.S.Abdul Gafoor
in C.R.P.Sr.No.127860 of 2019 R.SURESH KUMAR, J.
This petition has been filed to grant leave to the petitioners herein to file the above referred C.R.P.SR.No.127860 of 2019 to assail the order passed by the Wakf Tribunal of Tamil Nadu, Chennai, in O.A.No.73 of 2019, by order dated 05.09.2019. 2.In fact, in the said O.A.No.73 of 2019 before the Wakf Tribunal, the Adhoc Committee consisting of these petitioners were form part of the Committee. However, since Adhoc Committee had been named as 3rd respondent in the said O.A., it is the plea and claim of the present petitioners that, they have not been heard as in their individual capacity, they should have also been heard and without them, since the impugned order in O.A.No.73 of 2019 dated 05.09.2019 was passed by the Wakf Tribunal. Aggrieved over the same, since these petitioners wanted to assail the said order in the main revision, they seek indulgence to permit them to file this revision. 1/2

Sgl 3.I have heard Mr.T.Velumani, learned counsel for the petitioners, Mr.Nissar Ahmed, learned counsel for the 1st respondent and Mr.Lakshmi Narayanan, learned standing counsel for the respondents 2 and 3. Both the learned counsel appearing for respondents have fairly submitted that, since these petitioners herein are form part of the 3rd respondent in the O.A. i.e., Adhoc Managing Committee, they can very well file the main revision.
4.In that view of the matter, this Court is inclined to accept the prayer herein. Accordingly, the leave is granted and the Civil Miscellaneous Petition is allowed.
