The petitioner, who was arrested and remanded to judicial custody on 19.09.2023 for the offences punishable under Sections 279, 308, 336 of IPC r/w Sections 184 and 188 of the Motor Vehicles Act, in Crime No.713 of 2023 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 17.09.2023, while the petitioner was driving a Suzuki motorcycle bearing Registration No.TN-40-AC1810, he tried to lift the wheel of the motorcycle, due to which, he fell down and sustained fracture on his right hand. Hence, the case was registered against the petitioner herein.

3. The learned counsel for the petitioner submitted that no persons were injured in that accident and the petitioner has been in custody for the past 15 days. Hence, he seeks for grant of bail to the petitioner.

It is stated by the learned Government Advocate (Criminal Side) that the petitioner was driving a Suzuki motorcycle worth about nearly Rs.20,00,000/- by wearing a suit worth about more than Rs.2,00,000/-, only to gain publicity. It is also stated that he is a YouTuber with substantial following and he has influenced those who watch him in the YouTube and they also try to do the same motorcycle stunts, as he does. smv motorcycle while driving at high speed. Quite unfortunately for him and as an eye opener for everybody else who were watching, he fell down and suffered injuries.

5. This would be a lesson for everyone. He is in custody. Let him continue in custody. This Court is not willing to grant bail to the petitioner herein. Accordingly, this criminal original petition stands dismissed.

6. The concerned Medical Officer in the jail where the petitioner is in custody may examine the hand of the petitioner, which is said to have been fractured.
