passed by the 2nd respondent herein, quash the same and consequently direct the respondents to allot an alternative housing unit, more particularly HIG-4 situated in "A" Jettihalli, Neighbourhood Scheme, Dharmapuri which is said to be vacant, within the time to be stipulated.

ORDER
This Writ Petition has been filed, challenging the impugned order dated 12.09.2023, cancelling the allotment order made in favour of the petitioner and for a direction to the respondents to allot an alternative housing unit, more particularly, HIG-4 situated in "A" Jettihalli, Neighbourhood Scheme, Dharmapuri which is said to be vacant, within the time to be stipulated.

The learned counsel appearing for the petitioner would submit that the petitioner initially made an application to the Tamil Nadu Housing Board for allotment of housing unit in the locality of "A" Jettihalli, the Neighbourhood Scheme of Dharmapuri and, on 07.07.2014, the petitioner paid a sum of Rs.200/- as Application fee and sum of Rs.25,000/- as advance / security deposit amount, 2/7
totalling to a sum of Rs.25,200/- to the respondents. Thereafter, the petitioner was waiting for communication from the respondents.

While so, the 3rd respondent sent a letter dated 25.05.2018 to the petitioner requesting him to attend the drawal of lot to be held on 29.05.2018 and the respondent vide Regular Allotment Order No.HR4/2712/2014 dated 30.05.2018, allotted housing unit bearing No.HIG-83 with the total extent of 264.00 Sq.mtr by way of Lease-cum-Sale basis which is to be executed by the petitioner for a total consideration of Rs.45,04,000/- and the petitioner was directed to pay Rs.11,01,000/- within 21 days from the date of receipt of the order and failing which, the allotment orders will be cancelled. Thereafter, when the petitioner visited the respondents' Office to pay the balance amount as mentioned in the allotment order, he was informed by the 3rd respondent that a batch of writ petitions in W.P.No. 34406 of 2014 have been preferred by few persons in respect of HIG-83 which was allotted to the petitioner and hence, he was asked to pay the balance after the final decision was rendered.
4. Thereafter, the petitioner made a representation dated 07.06.2023 to the 3/7
1st respondent, requesting him to alternatively allot some other housing unit in the said locality, particularly, HIG-4 which is found to be vacant. The 1st respondent vide letter dated 03.07.2023 has called upon the petitioner to attend the personal hearing on 10.07.2023 with regard to the alternative allotment along with the supporting documents and relevant documents However, the 2nd respondent vide letter dated 12.09.2023 has informed the petitioner that the allotment order dated 30.05.2018 made in favour of the petitioner has been cancelled on the ground that the same was allotted to some other person. Challenging the same, this present writ petition is filed.

The learned counsel appearing for the petitioner submitted that petitioner has subsequently sent a representation dated 22.07.2024 for allotment of alternative house site in Phase -XV of Hosur Scheme, Plot No.MIG(I) 376, which is lying vacant, as per the vacant plot list issued by the Tamil Nadu Housing Board dated 19.06.2024, . He would further submit that though a larger prayer is sought for, it would suffice to direct the respondents to consider the representation dated 22.07.2024 and pass orders on the same within a time frame. 4/7
6. The learned counsel appearing for the respondents submitted that the petitioner's representation dated 22.07.2024 will be considered and, if any plot lying vacant, the same will be allotted to the petitioner on payment of the balance amount.
7. In view of the same, the respondents are directed to consider the petitioner's representation dated 22.07.2024 and pass appropriate orders on the same, on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
