Prayer: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to consider and pass orders of the petitioner's representation dated 30.12.2022, as per the provisions at the Street Vendors (Protection of Livelihood Regulation) Act 2014, made for granting permission/certificate of vending and till such time not to disturb with 1/4
the running of the petitioner's bunk shop at No.770, Binny Road, Anna Salai, (Front of Dewa Tower) Chennai-600 002 wherein selling Tea, Coffee, Juice, Cool drinks and chat and food tiffen items by using LPG Gas Stove. The petitioner herein seeks a direction to the respondents to consider his representation dated 30.12.2022 in the light of the provision of Street Vendors (Protection of Livelihood Regulation) Act 2014 and permit the petitioner to run a bunk shop at No.770, Binny Road, Anna Salai, (Front of Dewa Tower) Chennai 600 002.
2. It is the case of the petitioner that she is running a bunk shop in the above mentioned place and engaged in selling tea and other food items. The petitioner submitted a representation on 30.12.2022 to the respondents 2/4
requesting them to permit her to run a bunk shop in the above mentioned place, in the light of the Street Vendors Act, 2014. The said representation has not been considered. Therefore, the petitioner has come before this Court.
3. Mrs.P.T.Ramadevi, learned Standing Counsel takes notice for the respondents, on instructions, submitted that the representation of the petitioner will be considered on merits and orders will be passed within a time stipulated by this Court.
4. In view of the same, without expressing any opinion on the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the second respondent to consider the representation of the petitioner dated 30.12.2022 in the light of the Street Vendors Act, 2014 and pass final orders within a period of six weeks from the date of receipt of copy of this order. Till such time, the possession of the petitioner shall not be disturbed.
