ORDER

This petition has been filed seeking to clarify that the operative portion of the order dated 13.02.2025 passed by this Hon'ble Court in W.P.No.13118 of 2009, directing the petitioner/ company to pay compensation of Rs.4,00,000/- is not applicable to the respondents/ workmen viz. respondent nos.3 to 8, 10, 15, 16, 18, 23, 25, 27, 31 and 39 who had settled their disputes by entering into 18(1) settlement with the petitioner/ management and the petitioner/ management is liable to pay compensation only to the remaining 22 respondents/ workmen viz respondent nos.9, 11 to 14, 17, 19 to 22, 24, 26, 28 to 30 and 32 to 38.

2.The learned counsel appearing for the petitioner submitted that this Court while disposing the writ petition directed the petitioner management to pay a compensation at

Rs.4 Lakhs to each of the workmen/ respondents 3 to 39. The learned counsel further submitted that out of the 37 workmen, 15 of them were already settled and only 22 workmen have to be settled, however a confusion arose for the petitioner as to whether a sum of Rs.4 Lakhs has to be paid only to the 22 workmen who were not settled or to all the 37 workmen.

3.The learned counsel appearing for the private respondents fairly submitted that 15 workmen out of 37 workmen were already settled and only 22 workmen have to be settled.

4.In view of the above, this Court directs the petitioner to pay compensation only to the 22 respondents/ workmen viz respondent nos.9, 11 to 14, 17, 19 to 22, 24, 26, 28 to 30 and 32 to 38 who were not already settled. The operative portion of the order dated 13.02.2025 passed by this Hon'ble Court in W.P.No.13118 of 2009 is accordingly clarified.
