This case came up for settlement before the National Lok Adalat. Both the parties are present. The learned counsel for the appellant Mr.Anton Dhanasekaran, and the learned counsel for the respondents 1 to 3 Mr.P.Ravichandran, are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT Both the parties and counsel represented. The Transport Corporation has preferred the present appeal.

2. Aggrieved against the award of Rs.74,38,300/- (Rupees Seventy Four Lakhs Thirty Eight Thousand Three Hundred only).

3. Now the parties agreed to modify the award amount for a sum of Rs.89,50,000/- (Rupees Eighty Nine Lakhs Fifty Thousand only) in full quit inclusive of interest.

4. The Transport Corporation is directed to deposit the modified award amount less already deposited, if any within a period of eight weeks from today.

5. On such deposit the 1st claimant is entitled to withdraw the sum of Rs.50,00,000/- (Rupees Fifty Lakhs only), 3rd claimant is entitled to withdraw the sum of Rs.19,50,000/- (Rupees Nineteen Lakhs Fifty Thousand only), the 2nd claimant is entitled for a sum of Rs.20,00,000/- (Rupees Twenty Lakhs only)

and she being a minor her amount has been deposited in Nationalized Bank till she attained majority and the 1st claimant / mother is entitled to claim the quarterly interest.

6. The Tribunal is directed to issue the award amount through NEFT/RTGS to the party concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. 7.The appeal is ordered accordingly. Consequently, the connected civil miscellaneous petition is closed.
