Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the second respondent to consider the petitioner's representation dated 13.08.2024 to lay stone by metes and bound for the petitioner's property of an extent of 0.3 1⁄2 cents (0.1.40 Hec) in Survey No.668/4B, (Old Survey No.806), in Ketti Village-2, Coonoor Taluk, The Nilgiris District after the receipt of necessary charges in this regard. 1/5

O R D E R

The petitioner herein seeks a direction to the second respondent to consider his representation dated 13.08.2024 seeking survey of his property situated in S.No.668/4B (Old Survey No.806) with an extent of 0.3 1⁄2 cents (0.1.40 hec) at Ketti Village-2, Coonoor Taluk, The Nilgiris.

2. It is the case of the petitioner that he acquired right over the subject property under a registered sale deed dated 29.09.1986. She submitted a representation on 13.08.2024 before the second respondent seeking survey of the above mentioned property and the same has not been considered. Hence, the petitioner is before this Court.

3. Mr.P.Sathish, learned Additional Government Pleader, who takes notice for the respondents 1 & 2, would submit that if the petitioner submitted a proper online application and pay necessary charges seeking 2/5

survey of the property, the same will be considered on its own merits, within a time frame fixed by this Court.

4. In view of the same, without going into the merits of the claim made by the petitioner, she is directed to submit proper online application and pay necessary charges for survey of the above mentioned property within a period of two weeks from the date of receipt of copy of this order. If any such application is filed, the second respondent shall consider the same and pass final order, on its own merits, within a further period of six weeks thereafter.

5. With the above direction, this Writ Petition is disposed of. No costs.
