This petition is filed for a direction to the 1st respondent Management to pay the petitioner the last drawn wages under Section 17-B of the I.D Act, from the date of filing of the writ petition till the disposal of the writ petition.

2. The learned counsel for the petitioner has categorically averred in the sworn affidavit that, from the date of dismissal the petitioner was not gainfully employed anywhere. The respondents has not filed any counter denying the said averments.

3. The learned counsel for the 1st respondent submits that because of the financial difficulties faced by the Corporation, Corporation is not in a position to pay arrears of wages from the date of filing till date of disposal of the writ petition. The learned counsel further submits that this is a third accident committed by the petitioner, therefore Management is not inclined to reinstate 1/2 https://www.mhc.tn.gov.in/judis

WMP.No.28642 of 2023 the petitioner in service.

As the respondent has not denied the fact that the petitioner is not gainfully employed, the petition is allowed with a direction to the 1st respondent to pay the petitioner last drawn wage of Rs.29,063/- towards 17-B wages from this month and on or before 10th of every month till the date of disposal of the writ petition.
