ORDER

The petitioners have filed these Writ Petitions praying for issuance of Writs of Mandamus to direct the respondent to allot alternative place of residence to them by considering the representations of the petitioner, dated 25.01.2016.

2. The petitioners are residing in Bucks Road, Radhakrishnapuram, Raja Annamalaipuram, Chennai-600 028, for the past more than ten years by putting up huts, situated on the bund of Adyar river. Due to natural calamity in December 2015, the petitioners' huts completely got destroyed and the petitioners are now virtually in the streets and their families do not have any place of residence and feeling it difficult to meet the day-to-day livelihood. On the basis of the policy decision of the State Government to allot alternative accommodation to the persons who have lost their houses due to heavy rain, the Tamil Nadu Slum Clearance Board is implementing https://hcservices.ecourts.gov.in/hcservices/

the said decision by allotting alternative accommodation in Semmencherry, to the persons in the area. It is the grievance of the petitioners that one Selvi, who resides adjacent to the houses of the petitioners, bearing Door No.137 and Gopi in Door.No.138, were given allotment at Semmencherry through Slum Clearance Board, whereas the petitioners have not been allotted any alternative place of residence so far. Hence, the petitioners have given representations, dated 25.01.2016 requesting the respondent to provide alternative place of residence like others, by enclosing family ration cards, voters' identity cards, aadhar cards, etc. Inspite of the same, till date, the respondent has not provided the alternative accommodation to the petitioners. Hence, the petitioners have filed these Writ Petitions for the above relief.

3. Heard both sides.

Without going into the merits of the case, this Court directs the respondent to consider the said representation, dated 25.01.2016 of the petitioners and after giving an opportunity of personal hearing to the petitioners and necessary parties, pass appropriate orders and dispose of the said representations, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

5. With the above observations and directions, the Writ Petitions are disposed of. No costs.
