Crl. O.P. No.24182 / of 2024 P. DHANABAL.J., The petitioner / Accused-3, who apprehends arrest in the hands of the respondent police for the offences punishable under Sections 8(c), 20(b)(ii)(B) and 29(1) of Narcotic Drugs & Psychotropic Substances Act in connection with the Cr. No.227 of 2024, seeks anticipatory bail.

2. The case of the prosecution is that on 28.07.2024, near N4 Fishing Harbour pallam, based on the secret information, the respondent police along with their team, found the accused in illegal possession of 1.100 kgs of Ganja. Hence the case.

3. The learned counsel for the petitioner / 3rd Accused would contend that the respondent police have registered a false case against the petitioner for the alleged offences under Sections 8(c), 20(b)(ii)(B) and 29(1) of Narcotic Drugs & Psychotropic Substances Act, that he has been falsely implicated in this case and he is an innocent, that there are 4 accused and this petitioner is arrayed as A3, that A1 and A2 were already arrested and released on bail, that he is ready and willing to abide by any condition imposed by this Court in the event of his release on anticipatory

bail and hence he prayed for the grant of anticipatory bail to the petitioner.

The learned Government Advocate (Criminal Side) would submit that the accused were found with illegal possession of 1.100 kgs of Ganja, that there are 4 accused and except this petitioner, all other accused were arrested, that this petitioner is having 8 previous cases including one NDPS case and investigation is not yet completed. Hence he strongly opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record.

Considering the rival submissions on either side, considering the gravity of offences involved in this case, considering the fact that investigation is not yet completed, that this petitioner is having so many previous cases including NDPS case, I am declined to grant anticipatory bail to the petitioner at this stage.

7. Accordingly, the Criminal Original Petition is dismissed. 04.10.2024
