ORDER

This Writ Petition has been filed seeking for issuance of a Mandamus, directing the respondents to pay an outstanding amount of Rs.24,03,783/- to the petitioner towards the surplus unutilized banked energy sold to TANGEDCO from the period 2024-2025 alongwith interest.

2.Heard the learned counsel for the petitioner and the learned Standing counsel appearing for the respondents and perused the entire material available on record.

3.The case of the petitioner is that they had applied for wheeling of energy generated through the Wind Mills and they have also entered into a wheeling agreement with TANGEDCO. The petitioner had sent their invoices to TANGEDCO seeking for payment towards the surplus unutilized banked wind energy to TANGEDCO. Since the same was not settled, the present Writ Petition has been filed before this Court.

4.Taking into consideration the facts and circumstances of the case and considering the material placed before this Court, there shall be a direction to the 4 th respondent to settle the amount due and payable to the petitioner within a period of six(6) weeks from the date of receipt of a copy of this order subject to the petitioner producing all the necessary bills. If the amount is not settled

within the time frame fixed by this Court, it will carry an interest @ 7.5 % per annum from the date when the amount became payable till the date of actual payment.
