Prayer :- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Certiorari, to call for the records on the Second Respondent in his proceedings ROC. No. 34300/J3/2015-2 dated 12.04.2016, quash the same and consequently, direct the Third Respondent to refund amount already recovered from the Petitioners salary towards contribution to the new pension scheme with effect from January 2015 in the light of the judgment reported in W.A. (MD) No. 1026 of 2015 dated 30.09.2015.

Though the matter has been posted under the caption 'for dismissal', there was no representation for the Petitioners when the matter was called at 10.35 a.m. today, apart from the https://hcservices.ecourts.gov.in/hcservices/

earlier hearing on 11.03.2022. There does not appear to be any useful purpose being served in keeping the Writ Petition pending indefinitely when the Petitioners are not interested in prosecuting the same.

2. In such circumstances, the Writ Petition is dismissed for non-prosecution. It is made clear that the Petitioners are not precluded from applying for revival of the Writ Petition, if necessary, in accordance with law. Consequently, the connected Miscellaneous Petition is closed. No costs.
