The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 406 & 420 of IPC in Crime No.45 of 2023, seeks anticipatory bail.
2. It is stated that the de-facto complainant wanted to purchase the property and for that purpose had approached the first accused. The first accused had taken the defacto complainant to a builder and an account was opened to deposit the amount. The defacto complainant had deposit about Rs.1/- crore and the petitioner had obtained her ATM card and cheque. It is specifically stated that he had withdrawn a sum of Rs.36/- lakhs.
3. In view of this particular fact which requires further investigation to be done and recovery of the same to be done, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
