Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondents 1 to 5 to consider and pass orders on the representation made by the petitioner dated 06.02.2023 to cancel the conditional patta and to recover the encroached land from the sixth respondent and to measure and restore the burial ground and the pathway to burial ground comprised in Survey No.563 admeasuring 0.37.0 Hectares and Survey No.562/2 admeasuring 0.05.5 Hectares respectively in Puluvampatti Village, Perur Taluk, Coimbatore District and handover the same to Puluvapatti Town Panchayat all within a limited time frame. ORDER
(Made by the Hon'ble Chief Justice) Heard Mr.T.Tamilvanan, learned counsel for the petitioner and Mr.P.Muthukumar, learned State Government Pleader for the respondents 1 to 5.
2. Learned State Government Pleader has placed on record the communication from the Tahsildar, Perur. It is stated that action has been initiated to find out the original assignee or his legal heirs to proceed further to resume the subject land to Government by following due procedure and in accordance with law. It is further stated that the process can consume some time. However, the authorities have now initiated the process for resumption of the said land.
3. In view of the above, the writ petition is disposed of. There will be no order as to costs.
