Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) To suspend the sentence imposed upon the petitioner by the learned III Additional Sessions Judge, Vellore in Crl.A.No.23 of 2015 vide Judgement dated 01.08.2019 and release him on bail pending disposal of above CRL.R.C.NO.1058 of 2019.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.M.R.THANGAVEL, Advocate for the petitioner, and of MR. C. RAGHAVAN, Govt. Advocate ( Crl. Side) on behalf of the Respondent, the court made the following order:- This miscellaneous petition has been filed seeking to suspend the sentence imposed on the petitioner by judgment dated 01.08.2019 made in Criminal Appeal No.23 of 2015 by the learned III Additional Sessions Judge, Vellore , partly allowing the judgment of conviction dated 25.09.2015 made in C.C.No.38 of 2005 by the learned Principal District-cum-Judicial Magistrate, Vaniyambadi, Vellore District, and enlarge the petitioner on bail, pending disposal of the above criminal revision.
2. Heard both sides.
3. Having regard to the facts and circumstances of the case, this miscellaneous petition is ordered and the substantive sentence of imprisonment alone is suspended on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Vaniyambadi and the petitioner shall appear before the trial Court on the first working day of every month at 10.30 a.m until further orders. In case any of the conditions are not complied with, the interim order of suspension of sentence shall stand vacated automatically without further reference to this Court. -sd/- 10/10/2019 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
