P. DHANABAL.J., The petitioners apprehend arrest for the alleged offences under Sections 318(4) of BNS Act, 2023 and 66D of Information Technology Act in Crime No.94 of 2024, on the file of the respondent police seek anticipatory bail.

2.The case of the prosecution is that the defacto-complainant received phone call from unknown person and the accused persons introduced themselves as Cyber Crime Officers and they stated the savings account of the defacto-complainant was misused by some other persons, so that the accused persons through phone directed the defacto-complainant to transfer your amount to their account and they promised to safeguard the money of the defacto-complainant. Believing their words, the defactocomplianant transferred his money to the accused persons. The accused persons cheated the defacto-complainant and swindled the money. Hence the case.

3. The learned counsel for the petitioners would contend that these petitioners have been falsely implicated in this case. These petitioners are innocent persons and they have not indulged in any illegal activities as alleged by the prosecution and they have been falsely implicated in this case by the respondent police. Hence, he seeks anticipatory bail to the petitioners.

4. The learned Government Advocate (Criminal Side) would submit that the petitioners cheated the defacto-complainant and transferred the amount illegally to various persons. The allegations are serious in nature. In this case, investigation is at initial stage. Hence, the learned Government Advocate (Criminal Side) vehemently opposed to grant anticipatory bail to the petitioner.

5. Heard both side and perused the materials available on record.

6. Considering the representations made on both sides and considering that the investigation is at initial stage and the offences are grave in nature, at this stage, this Court is not inclined to grant anticipatory bail to the petitioners.

7. Accordingly, this Criminal Original Petition is dismissed. 26.09.2024 gvn
