C.M.P.No.911 of 2023 in C.M.A.SR.No.122885 of 2022 N.MALA, J.

This Petition has been filed to condone the delay of 154 days in filing the appeal in C.M.A.SR.No.122885 of 2022 against the judgment and decree made in MCOP.NO.105 of 2021 dated 22.01.2022 on the file of the Motor Accidents Claims Tribunal, Additional District Judge, Fast Track Mahila Court, Nagapattinam.

2. Though notice is served on the first and fourth respondents none appeared. M/s.V.Mythili, the learned counsel takes notice for the second respondent and Mr.S.R.Sundar, the learned counsel takes notice for the third respondent. The learned counsel for the second and third respondents fairly submit that they have no serious objection to condonation of the above said delay.

3. In view of the submissions made by the learned counsel for the second and third respondents, the delay of 154 days is condoned and the petition is ordered.

4. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same for admission and print the name of M/s.V.Mythili and Mr.S.R.Sundar in the cause list at the time of admission.

5. Accordingly, this CMP is ordered.
