C.M.P.Nos.20350, 20353 & 20354 of 2022 in A.S.No.381 of 2014 S.S.SUNDAR, J., and N.MALA, J., [Order of the Court was made by S.S.SUNDAR, J.,] (1)The above miscellaneous petitions have been filed to condone the delay of 437 days in filing the petition to set aside the abatement caused due to the death of the first respondent in the Appeal, by name Chellaperumal; to set aside the abatement and to bring on record, proposed respondents as respondents 7 to 10 in AS.No.381 of 2014.
(2)The above applications are not seriously opposed. This Court is convinced with the reasons stated in the affidavit filed in support of the petition to condone the delay.
(3)Since the delay has been properly explained and there is no dispute with regard to the relationship between the deceased first respondent and the proposed parties, this Court is inclined to allow all the above miscellaneous petitions.
