Prayer: Writ Petition is filed under Article 226 to issue a Writ of Mandamus directing the third respondent herein to consider the petitioner online application dated 26.12.2020 in application no. 2020 / 0105 / 35 / 303154 dated 26.12.2020 seeking sub-division of his property situated at Vaiyavur Village, Madurantakam Taluk, Chengalpattu District in Survey No 259/4 admeasuring to an extent of 68 cents and to issue patta in his name for the same For Petitioner :

The petitioner seeks a mandamus to the 3rd respondent to consider his online application dated 26.12.2020 in Application No.2020/0105/35/303154 dated 26.12.2020, seeking subdivision of his properties situate at Vaiyavur Village, Madurantakam Taluk, Chengalpattu District in Survey No 259/4, admeasuring an extent of 2/7

68 cents.

2. The petitioner's contention is that originally the property in question belonged to one Radhakrishnan son of Lakshmana Naicker. This property was alloted to the said Radhakrishnan under a partition between him and his brothers in the year 1982. The petitioner purchased the property from the said Radhakrishnan under a sale deed dated 15.12.2008.

3. After his purchase, the petitioner had approached the 3rd respondent to effect subdivision of the property and to issue separate patta in his name. Since there is no response, the petitioner has approached this Court.

4. Heard the learned counsels on the either side and perused the records.

5. The property in question has been purchased by the petitioner in the year 2008 and his request for subdivision has been pending since the year 2020. Therefore, mandamus is issued to the 3rd respondent to consider the online application of the petitioner and survey and subdivide the lands and thereafter issue separate patta to the petitioner. The said exercise shall be completed within a period of 6 weeks from the date of receipt of a copy of this order.

6. With the above observation, the Writ Petition is allowed. No costs.
