Respondents Writ petition filed under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the 1st and 2nd respondents to immediately act upon the petitioner's representation dated 05.11.2013 pertaining to the acquisition of the petitioner's lands comprised in S.No.674/1 situate at Sholinganallur village within Pallikaranai Sub Taluk, Tambaram Zone, Kancheepuram District and settle the legitimate compensation amount on par with the other petitioners covered in WP.Nos.22118/2007 etc., by order dated 02.08.2007 within a time frame to be fixed by this Court.

ORDER

Heard the learned counsel for the petitioner ; Mr.R.M.Muthukumar, learned Additional Government Pleader, appearing on behalf of the respondents and with their consent, the writ petition is taken up for final disposal. The petitioner has filed this writ petition seeking for issuance of a writ of mandamus to direct the respondents to pay adequate compensation on par with the other land owners / petitioners in WP.No.22118/2007 by considering his representation dated 05.11.2013.

Learned counsel appearing for the 3rd respondent submitted that six weeks time may be granted to the 3rd respondent to take note of the facts and release the payments for which the petitioner is entitled to.

The other land owners, similarly placed that of the petitioner herein, had approached this Court for an identical relief by filing writ petitions in WP.Nos.537/2014 and 1705/2014 and those writ petitions were disposed of, by order dated 19.03.2014, directing the respondents therein to consider the petitioners' representations and pass appropriate orders on merits and in accordance with law.

The learned counsel for the petitioner submitted that the petitioner herein would be satisfied if similar direction is issued.

Learned Additional Government Pleader submitted that the earlier directions of this Court, have been complied with by the respondents and orders have been passed. In the light of the above, there will be a direction to the 2nd respondent to consider the representation of the petitioner dated 05.11.2013 and pass appropriate orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The writ petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
