O R D E R
The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondent herein to allot a house to the petitioner at Nochi Nagar, Marina Scheme in the houses which are vacant without allotting to anyone under the Tsunami Relief Scheme. 2.The learned counsel appearing for the petitioner submitted that the petitioner is hailing from Fisherman community and her family was residing at Nochikuppam Slum Clearance Board Area and due to Tsunami, the entire area was washed out and the petitioner and similarly place people became homeless and considering the pathetic condition, the Government of Tamil Nadu with the aid of World Bank constructed tenements for such people. The petitioner was allotted a residential house at Okkiam Doraipakkam and since it is far away from Nochikuppam, she requested the respondent to allot permanent residence in Marina Area of Nochi Nagar Scheme, however, her request has not yet been considered. 3.The learned counsel appearing for the petitioner further submitted that this Court may issue direction to the respondent to allot 2/4
a suitable tenement to the petitioner.
4.The learned counsel appearing for the respondent submitted that this Court may direct the petitioner to appear before the Estate Officer, Division - 5, Tamil Nadu Urban Habitat Development Board, 212, Ramakrishna Madam Road, Mylapore, Chennai and further submitted that if the petitioner appears before the Estate Officer, the Estate Officer will conduct enquiry and will forward necessary proposal to the respondent and the respondent will consider the same and will pass appropriate orders thereafter.
5.Considering the submissions made on either side, this Court directs the petitioner to appear before the Estate Officer, Division - 5, Tamil Nadu Urban Habitat Development Board, 212, Ramakrishna Madam Road, Mylapore, Chennai on 05.11.2024 at 10.30 a.m., along with relevant documents. On such appearance of the petitioner, the Estate Officer shall conduct enquiry and shall forward necessary proposal/ recommendation to the respondent and upon receipt of such proposal/ recommendation, the respondent shall consider the same and shall pass appropriate orders, as expeditiously as possible. 3/4
