This petition is filed to grant leave permitting the petitioner/appellant to prefer Criminal Appeal against the dismissal order passed in STC No.3233 of 2024 on the file of XIII Metropolitan Magistrate, Egmore dated 04.06.2024.

2. The learned counsel for the petitioner would submit that due to the absence of the representative of the petitioner and for non-payment of batta, the complaint was dismissed. He would further submit that the absence was neither willful nor wanton and that the complaint was dismissed on the second hearing.

3. This court is satisfied with the submissions made by the learned counsel for the petitioner and hence inclined to grant leave. Accordingly, leave granted.

4.The Registry is directed to number the appeal and post for admission, if it is otherwise in order.
