ORDER

This criminal original petition has been filed seeking to quash the FIR in Cr.No.338 of 2024 pending on the file of the first respondent.

2. The learned counsel for the petitioner would submit that due to a civil dispute, a false case has been foisted against the petitioners. A civil suit is already pending before the District Munsif Court, Kallakurichi. It is further submitted that the second petitioner , who is the son of the first petitioner, was travelling from Mumbai to Chennai at the time of the alleged occurrence and was therefore not present at the scene of occurrence.

3. The learned Government Advocate (crl.side), appearing for the first respondent, on instructions, would submit that there is a case and a counter case and that investigation in both the matters is still in progress.

4. On perusal of the FIR, this Court find that though serious allegations have been made, physical injuries also said to have been caused.

5. In such view of the above, a proper detailed investigation is required in this matter and hence, this is not a fit case for quashing the FIR at this stage.

6. The Investigation Officer is directed to take note of the contention that the second petitioner was not present in Kallakurichi District at the time of the alleged occurrence and was travelling from Mumbai to Chennai, and to verify the passport and all other relevant documents and aspects.

7. Accordingly, this criminal original petition is disposed of with the above direction. Consequently, connected miscellaneous petition is closed. 22-08-2025 mrp
