O R D E R
The petitioner has filed this petition to direct the respondents to grant the patta ad-measuring an extent of 1 acre comprising in Survey No.25/13 which is situated at Nainarpalayam Village, Chinna-Salem Taluk, Kallakurichi District as classified in the revenue records as "Natham Tharisu" based on the proceedings of the second respondent in C.P.A.No.A2/311/2024 dated 10.10.2024 and petitioner representation dated 24.07.2025.
2. The case of the petitioner is that the subject matter of the land ad measuring an extent of 1 acre comprising in S.No.25/13, situated at Nainarpalayam Village, Chinna-Salem Taluk, Kallakurichi District as classified in the revenue records as "Natham Tharisu" originally belongs to one Ramasamy, who is the father of the petitioner. After his demise, the petitioner enjoying the said property by cultivating paddy for more than 20 years. As a landless poor, the petitioner is entitled to patta for the aforesaid land in terms of G.O.No.296, Rev. dated 10.02.1954 B.P.Mis.No.1791, dated Page No.2 of 5
21.12.1956. Therefore, he made a representation dated 24.07.2025, before the second respondent, seeking patta on his favour in respect of the aforesaid subject matter property. However, till date, no order was passed. Hence, the petitioner has come forward with the present writ petition.
3. Learned Special Government Pleader appearing for the respondents submitted that if the petitioner is entitled for issuance of patta, the petitioner's representation dated 24.07.2025 will be considered by the respondents, after verification and enquiry.
4. Heard the learned counsels on either side and perused the materials available on record.
5. Considering the above submission, this Court directs the respondents to consider the petitioner's representation dated 24.07.2025 on merits, in accordance with law and pass detailed order about the petitioner's eligibility to get the patta in the light of G.O.No.296, Rev. dated 10.02.1954 B.P.Mis.No.1791, dated 21.12.1956, within a period of three months from the date of receipt of a copy of this order.
