..Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent to enhance the fixed travelling allowance at Rs.3000/- per month and pay the same in accordance with the pay commission revision with effect from 2016. This writ of mandamus has been instituted to direct the respondents to enhance the fixed travelling allowance at Rs.3000/- per month and pay the same in accordance with the pay commission revision with effect from 2016.
2. The petitioners are working in the High Court as Bailiffs. They have submitted a representation to the Registrar General of High Court seeking enhancement of fixed travelling allowance at the rate of Rs.3000/- per month. Based on the representation of the petitioners, the High Court submitted multiple proposals to the Government for consideration. Finally the Government considered and rejected the claim vide Letter No.24537/HomeCourts V/2020-4 dated 02.04.2026 stating that enhancement of fixed travelling allowance is not feasible for consideration at this juncture. Further, the Government has stated that same may be examined at the time of general pay revision in the ensuing 8th Pay Commission.
3. This Court is of the considered view that the relief as such sought for in the writ petition is misconceived. Bailiffs themselves have fixed the enhanced fixed travelling allowance to be paid to them and submitted a representation without any basis or by not relying upon any of the Government Orders or the Rules in force. Any claim relating to pay or allowances must be based on the Pay Rules or Government Orders in force. If at all any grievance with respect to the pay or allowance exists, such grievances are to be placed before the Grievances Redressal Committee constituted in pursuance to the Pay Commission and it is necessary for the High Court to
examine such representation in a judicious manner including the entitlement of the employees with reference to the Pay Rules in force and Government Orders and then submit necessary proposals.
